Terms and Conditions

1. INTERPRETATION

In these Terms and Conditions (the “Conditions”), the following definitions apply:

“Confirmation” – the submission by the Customer of an order for a Hospitality Package via the Website.
“Contract” – a legally binding agreement formed in accordance with Clause 2 of these Conditions.
“Customer” – the purchaser of the Hospitality Package.
“Deposit” – any deposit amount payable as stated on the Seller’s invoice or as otherwise displayed on the Website.
“Event” – any entertainment event, including but not limited to concerts, exhibitions, sports fixtures, theatre performances or music events, to be held at a Venue for which the Seller has the right to sell Hospitality Packages.
“Hospitality Package” – the package sold by the Seller to the Customer which may include, without limitation, an Event ticket and associated hospitality services such as food, beverages, and use of hospitality facilities at or near the Venue.
“Price” – the total amount payable for the Hospitality Package as stated on the Website or otherwise confirmed in writing by the Seller.
“Promoter” – the person or organisation responsible for staging the Event, if different from the Venue.
“Seller”Powerful Tickets, a trading division of The Powerful Group Limited, registered in England and Wales, with its registered office at 7A High Street, High Barnet, Greater London, EN5 5UE.
“Tickets” – the physical or electronic passes, tickets, badges or similar forms of entry sold by the Seller to the Customer as part of a Hospitality Package, providing access or rights to attend an Event.
“Venue” – the location or facilities where the Event takes place.
“Website” – the Seller’s official website where Hospitality Packages and Tickets are sold and these Conditions are displayed.

1.1. Headings are for convenience only and do not affect interpretation.
1.2. Any reference to a statute includes all amendments, re-enactments or extensions in force at the relevant time.
1.3. Words in the singular include the plural (and vice versa); references to any gender include all genders.

2. BASIS OF SALE

2.1. All Hospitality Packages and Tickets are sold subject to availability and these Conditions. The receipt by the Seller of a Confirmation constitutes a booking by the Customer and, subject to availability, forms a Contract between the Seller and the Customer.

2.2. These Conditions incorporate any additional terms stated on the Website in relation to specific Events or Venues and should be read alongside the terms of the Venue and/or Promoter. In the event of conflict, the Promoter’s terms will take precedence, or if there is no Promoter, the Venue’s terms will prevail.

2.3. No variation of these Conditions or the Contract shall be valid unless confirmed in writing by an authorised representative of the Seller. Each party acknowledges that it has not relied upon any representation, statement or warranty not expressly set out in these Conditions. Nothing in this clause excludes liability for fraud.

2.4. The Seller reserves the right to correct any typographical, clerical or other errors in any materials issued by it without incurring liability.

3. VARIATION

3.1. The Seller may make minor changes to the Hospitality Package that do not materially affect its overall quality or value.

3.2. If a material change (as reasonably determined by the Seller) is required, the Seller will use reasonable efforts to offer an alternative package of comparable standard, or, if unavailable or unacceptable to the Customer, refund any Deposit and Price paid.

4. PRICE

4.1. The Seller reserves the right to adjust Prices before delivery of Tickets to reflect any increase in its costs (including but not limited to foreign exchange rates, duties, or taxes) provided the Customer is notified in writing.

4.2. All Prices are exclusive of VAT and other applicable taxes, which shall be payable in addition.

5. PAYMENT

5.1. Full Payment at Time of Purchase
All Hospitality Packages and Tickets must be paid for in full at the time of booking, regardless of the date of the Event. No booking shall be confirmed until full payment has been successfully received and processed by the Seller or its authorised payment partners.

5.2. Payment Methods
Payments can be made online via the Website using major debit or credit cards, or through the Seller’s secure third-party payment partners including Stripe and PayPal, which offer high levels of encryption, security, and customer protection. By completing a purchase, the Customer agrees to the respective payment processor’s terms and privacy policies.

5.3. Payment Plans and Deferred Options
The Seller may, from time to time, offer third-party payment options such as Klarna, which allow Customers to split the cost of their purchase into instalments or to pay at a later date. Use of these services is subject to approval by the payment provider and their individual terms and conditions.

  • The Customer enters into a direct financial agreement with the payment provider when using such options.

  • The Seller is not responsible for the acceptance, rejection, or administration of these credit arrangements.

  • The Seller will consider an order confirmed only once the payment provider has authorised the transaction.

5.4. Booking Confirmation
Upon successful payment, the Customer will receive an email confirmation and digital receipt from the Seller. This confirmation serves as proof of purchase and forms a binding Contract between the Customer and the Seller, subject to these Conditions.

5.5. Currency and Fees
All Prices are displayed in pounds sterling (GBP) and include all applicable taxes unless otherwise stated. The Seller is not responsible for any additional charges levied by the Customer’s bank, card provider, or payment platform (including exchange rate differences or international transaction fees).

5.6. Payment Security
The Seller uses secure SSL encryption and PCI DSS-compliant systems to protect payment data. The Seller does not store full card details and will never request such information via email or other insecure channels. Customers are advised to contact support@powerfultickets.com immediately if they suspect unauthorised use of their card or account.

5.7. Failed or Reversed Payments
If a payment fails, is reversed, or disputed (for example, through a chargeback), the Seller reserves the right to cancel the associated booking and invalidate any Tickets or Hospitality Packages issued. Any reinstatement of a booking will be at the Seller’s sole discretion and may require a new payment.

5.8. Non-Refundable Transactions
All payments are non-refundable except in cases expressly set out in these Conditions (such as Event cancellation). Once a booking is confirmed, the Customer is committed to the purchase, even if unable to attend the Event. Customers are encouraged to purchase suitable event insurance if required.

6. DELIVERY OF TICKETS

6.1. Delivery shall be deemed complete when Tickets are collected, delivered to the Customer or dispatched via post or courier.

6.2. Delivery times are approximate. The Seller accepts no liability for delays beyond its control.

6.3. Tickets will not be issued until full payment has cleared. The Seller will aim, but is not obliged, to dispatch Tickets no later than two weeks before the Event.

6.4. The Seller may arrange for collection at the Venue if necessary, and will inform the Customer accordingly.

6.5. The Customer must check Tickets upon receipt as errors cannot always be rectified.

7. RISK AND PROPERTY IN TICKETS

7.1. Risk passes to the Customer upon delivery, dispatch or collection, whichever occurs first.
7.2. Once risk has passed, the Seller has no obligation to replace lost or damaged Tickets. Duplicate Tickets may be issued only at the discretion of the Venue or Promoter.
7.3. Ownership of Tickets remains with the Seller until full payment is received.
7.4. Tickets are non-transferable and must not be resold or used for commercial promotions without written consent.
7.5. Seat locations are provided by the Venue or Promoter and may change if operationally required.
7.6. Possession of a Ticket does not grant rights to any logos, trademarks, or intellectual property appearing on it.

8. EVENTS AND CANCELLATIONS

8.1. Customers may cancel at any time but will be subject to the following charges:

  • More than 12 weeks before the Event: Deposit retained.

  • Less than 12 weeks before the Event: 100% of Price retained.

8.2. The Seller does not control Event scheduling and cannot guarantee that any Event will take place. No refund is due unless otherwise stated in these Conditions.

8.3. Customers are responsible for confirming Event times and dates. The Seller will make reasonable efforts to notify Customers of cancellations or changes but cannot guarantee notice.

8.4. If an Event is postponed, the booking will usually remain valid for the rescheduled date unless the Venue changes.

8.5. Refunds for cancellations or postponements will be limited to those offered by the Venue or Promoter. Customers are encouraged to obtain insurance for such risks.

8.6. Refund requests must be made promptly upon learning of an Event cancellation.

8.7. For sporting events, dates and times are subject to change. Customers must check final details with the relevant authority.

8.8. Nothing in these Conditions affects statutory consumer rights.

8.9. The Seller accepts no liability for acts or omissions of the Promoter, Venue, or Event organisers.

8.10. Any complaints must be submitted in writing within a reasonable time after the Event to support@powerfultickets.com.

9. LIMITATION OF LIABILITY

9.1. The Seller will not be liable for indirect, consequential, or economic loss (including loss of profit or revenue). The maximum liability to the Customer will not exceed the total Price paid for the Hospitality Package.
9.2. Nothing in these Conditions limits liability for death or personal injury caused by negligence.

10. FORCE MAJEURE

The Seller is not liable for any delay or failure to perform obligations due to circumstances beyond its reasonable control, including acts of God, war, terrorism, fire, flood, extreme weather, strikes, or Event cancellation.

11. CUSTOMER DEFAULT

The Seller may cancel the Contract if the Customer breaches any obligation, becomes insolvent, bankrupt, ceases trading, or fails to make payments as required.

12. INDEMNITY

The Customer agrees to indemnify the Seller for all costs, losses, or claims resulting from the actions or omissions of the Customer or their guests, including damage caused at the Venue.

13. VENUE CONDITIONS

13.1. Customers must comply with all Venue and Promoter rules and regulations.
13.2. Resale or transfer of any Hospitality Package or Ticket without written consent is prohibited.
13.3. Tickets may not be used for promotions, raffles, or similar without permission.
13.4. Recording or broadcasting at the Venue is prohibited.
13.5. Venues reserve the right to refuse entry or remove attendees for misconduct, without refund.
13.6. Smart casual dress is generally required; specific Event guidelines apply.
13.7. The Seller, Venue, and Promoter accept no responsibility for loss or damage to personal belongings unless caused by their negligence.
13.8. Attendance at Events constitutes consent to photography, filming, and sound recording.

14. GENERAL

14.1. The Contract is personal to the Customer and may not be assigned without the Seller’s consent.
14.2. Notices must be delivered in writing or by email to the addresses provided.
14.3. Failure by the Seller to enforce any right does not constitute a waiver.
14.4. Nothing in these Conditions creates a partnership or joint venture.
14.5. No third party has rights under the Contracts (Rights of Third Parties) Act 1999.
14.6. If any provision is found invalid, the remainder will remain in force.
14.7. Personal data is processed in accordance with the Seller’s Privacy Policy available on the Website.
14.8. The parties agree to attempt to resolve disputes amicably and in good faith.
14.9. These Conditions are governed by and construed in accordance with the laws of England and Wales, and the English courts shall have non-exclusive jurisdiction.
